| Rental Agreement
1. CHECK-IN TIME IS AFTER 3 P.M. EST AND CHECK-OUT IS 11 A.M. EST.
NO Early Check-in or late check-out.
2. Pets are not permitted in rental units under any conditions.
3. DAMAGE/RESERVATION DEPOSIT- A damage deposit of $200.00 is required. This must be received thirty (30) days prior to your arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (4) days of departure, provided the following provisions are met.
a. No damage is done to the villa or its contents, beyond normal wear and tear.
b. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
c. All charges accrued during the stay are paid prior to departure.
d. No linens are lost or damaged.
e. NO Early check-in or late check-out (without prior arrangement).
4. PAYMENT – An advance payment equal to 25% of the rental rate is required upon booking requested been confirm. The advance payment will be applied toward your rent. Please make payments in the form of traveler's checks, bank money orders, cashiers checks or personal checks payable to Cavel Capalbo. The advance payment is not a damage deposit. The BALANCE OF RENT is due sixty (60) days before your arrival date.
5. CANCELLATIONS – A ninety (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur a processing fee of 10% of rental ((90 days for holidays - Easter, Thanksgiving, Christmas and New Years rentals), less a 20% cancellation fee on money already paid. Cancellations or changes that result in a shortened stay, that are made within 60 days of the arrival date, forfeit the full advance payment and damage/reservation deposit (guest can choose alternate dates). If the villa is re-rented with will refund your deposit. Cancellation or early departure does not warrant any refund of rent or deposit.
6. MONTHLY RESERVATION CANCELLATIONS – Monthly renters must cancel one hundred twenty (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least ninety (90) days prior to check-in.
7. MAXIMUM OCCUPANCY- The number of persons occupying the property must not exceed the number stated in the Reservation Invoice nor can it ever exceed the stated capacity of the villa unless specifically stated in the Reservation Invoice. The maximum number of guests per Villa is limited to (15) fourteen persons. There is a charge of $25.00 per night for each additional guest above our agreed # stated on your invoice; this must be paid directly to the housekeeper up on arrival. Exceptions are made only for infants (under 3 years old); if sleeping in parent’s bedroom and in a baby crib and not occupying one of the villa's beds, they are not included in the villa's total headcount
THIS PROPERTY REQUIRES A THREE (3) NIGHT MINIMUM STAY.
8. Longer minimum stays may be required during holiday periods. If a rental is taken for less than three days, the guest will be charged the three-night rate.
9. Transportation: Rates include airport transfers
10. DAILY MAID SERVICE –Daily maid service Cook, pool/ground attendant, security, Linens and bath towels are included in the villa rental rate.
11. RATE CHANGES – Rates subject to change without notice.
12. FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
13. WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.
14. HURRICANE OR STORM POLICY – In the event of flight cancellations due to a hurricane Ocean View Villa will do everything possible to help with either extending your vacation or rescheduling at another time. We would encourage you to purchase trip cancellation insurance to protect your investment.
No refunds will be given unless:
a. The National Weather Service orders mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
b. A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
1. Any unused portion of rent from a guest currently registered,
2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and
3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period. By Signing Below, I agree to all terms and conditions of this agreement
15. Services Included/Excluded. Except where specifically noted in the detailed property descriptions and/or in Ocean View Reservation Invoice, rental prices include utilities, villa staff which typically would include cook, housekeeper and gardener/pool person. Specifically excluded from the rental price are costs for all telephone calls, nanny or baby-sitter, guide, chauffeur, automobile, lessons, etc. If such services are offered at all, they are payable directly from the client to the person providing this service.
Quiet Enjoyment and Parties. Ocean View Villa wishes to maintain a family atmosphere for the quiet enjoyment of guests. We rent to family groups and responsible adults only. Absolutely NO house parties or functions such as weddings are allowed without advance written permission from Ocean View Villa. Guests shall be sufficiently quiet and peaceful, so as not to disturb other residents of the neighborhood.
Villa Security (non-guest policy). We attempt to maintain good security. You are welcome to have visitors; however, for your safety as well as future guest, please provide the names of visitors/ family members prior to arrival or upon arrival to Millicent or Lindo, this is for your personal safety and protection.
Limitations of Liability.
THE VILLAS, TRANSPORTATION CARRIERS AND OTHER SUPPLIERS PROVIDING TRAVEL OR OTHER SERVICES ARE INDEPENDENT CONTRACTORS AND NOT AGENTS OR EMPLOYEES OF OCEAN VIEW. OCEAN VIEW VILLA IS NOT LIABLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES OR NEGLIGENCE OF ANY SUCH SUPPLIERS OR FOR ANY PERSONAL INJURIES, DEATH, PROPERTY LOSS, PROPERTY DAMAGE, OR OTHER DAMAGES, LOSSES OR EXPENSES RESULTING THEREFROM
